Male patient who woke from operation wearing women's pink knickers sues hospital

A man has launched legal action after claiming he woke up from a bowel examination wearing women's pink knickers.

Andrew Walls, 32, says he noticed the loud lingerie as the anaesthetic wore off following a colonoscopy medical procedure.

Mr Walls, from the city of Dover, Delaware, claims the incident happened at Delaware Surgery Centre in October 2012.

And in court papers his lawyer states he suffered mental anguish, lost wages and loss of earning capacity.

According to Delaware Online, Mr Walls was an employee at the surgery at the time of the procedure.

"The defendant's extreme and outrageous conduct went beyond all possible bounds of decency," wrote attorney Gary Nitsche in the civil damages suit filed in New Castle County Superior Court.

The suit reads: "When the plaintiff recovered from the effects of the anesthesia administered by defendants, he awoke to realise that while he was unconscious pink women's underwear had been placed on his body.

"When the plaintiff initially presented for his colonoscopy he had not been wearing pink women's underwear and at no time did the plaintiff voluntarily, knowingly or intentionally place the pink women's underwear upon himself."           

Delaware Surgery director Jennifer Anderson declined to comment to reporters in Delaware this week.
